Bullivant Houser Bailey's namesake partner, Doug Houser, will be speaking at the American Bar Association Property Insurance Law Committee's Annual Spring CLE Meeting. The topic of the Spring Meeting is "Exclusions and Extensions of Coverage in All-Risk Policies."
Doug will present on Friday, May 17 on "Burden of Proof Issues." This session will discuss trial practice issues inherent to property coverage litigation. The discussion will focus on issues of proof including: (1) insured's burden to prove covered loss occurred; (2) insurer's burden to prove an exclusion applies; (3) insured's burden to prove exception to exclusion; (4) how declaratory judgment posture affects burden of proof; and (5) the impact of burden of proof issues on trial.
Additional presentations will range from burdens of proof to the intricacies of water damage, cyber coverages and collapse provisions. These policy exclusions and extensions have seen many changes over recent years and the presentations will provide insights into these changes, the overall effect these provisions have on all-risk policies, and the case law bearing on these issues. These issues will be presented by top-notch, captivating speakers from all areas of insurance law — judges, plaintiff's attorneys, defense attorneys, industry representatives, and experts.
